Major Win For AFSCME Members

AFSCME Members in the Department of Children and Families won a major victory this month with several union members receiving earned overtime pay that their employer attempted to deny them.

On June 30, 2013, several members had their position retitled and applicants were no longer required to be certified social workers.

The Union, on behalf of its members, successfully argued that due in part to the removal of the requirement to be a certified social worker, its members no longer fit into the exemption provided to employers with regard to not having to pay overtime for hours worked beyond 40 in a week.

Workers in the facility received earned overtime pay totaling, pending appeal, $35,898.26 combined for all the affected workers. 

“We are very pleased to see the Labor Standards Investigator make the right decision by workers in this case,” said Executive Director of Council 32 Rick Badger. “We are out there every day fighting with working people to ensure they are treated fairly in the workplace. Successes, like this one, are a great reminder of how workers can change their workplace for the better when they stand together.”
